Sun and Rocks is the trading name used by Sergej Nikolajev, a sole trader.

Please read these Terms of Service before placing an order. By using our website or placing an order, you agree to these terms, subject to your statutory rights under applicable law.

1. About us

Sun and Rocks sells wine through its online store. In these terms, “we”, “us” and “our” mean Sergej Nikolajev trading as Sun and Rocks. “You” and “your” mean the customer using our website or purchasing our products.

If you have a question about an order, product or these terms, contact us at sunandrockswine@gmail.com.

2. Using our website

You agree to use our website lawfully and not to misuse it, interfere with its operation, attempt unauthorised access or use it to carry out fraudulent activity.

You must provide accurate, complete and up-to-date information when placing an order, including your contact details and delivery address.

We may restrict or suspend access to our website where reasonably necessary for security, maintenance or to prevent misuse.

3. Age restrictions and delivery of alcohol

You must be at least 18 years old to purchase alcohol from Sun and Rocks. By placing an order, you confirm that you are at least 18.

We may use an age-verification app during the purchase process. The delivery recipient must also be at least 18 years old. Our courier may request valid photographic identification if the recipient appears to be under 18 or if age verification is otherwise required.

If the recipient cannot provide satisfactory proof of age when requested, the courier may refuse delivery. We may also refuse or cancel an order where we cannot reasonably verify that the purchase complies with applicable age restrictions or licensing requirements.

You must not purchase alcohol on behalf of anyone under 18 or arrange for alcohol to be supplied to a person under 18.

4. Products and availability

We make reasonable efforts to ensure that product descriptions, photographs, prices and other information on our website are accurate.

All products are subject to availability. If an item becomes unavailable after you place an order, we will contact you to discuss an appropriate solution, such as a replacement agreed with you or a refund.

Nothing in these terms limits your statutory rights if a product is faulty, not as described or otherwise fails to meet the requirements of applicable law.

5. Prices and payment

All prices are displayed in pounds sterling (£) unless stated otherwise. Any applicable taxes and delivery charges will be shown as part of the ordering process before you place your order.

Payment must be made using the payment methods available at checkout. You authorise us and our payment service providers to process the payment for your order.

We take reasonable care to ensure that prices are accurate. However, mistakes can occasionally occur. If we discover a pricing error, we will deal with it as described in Section 6.

6. Orders, acceptance and pricing errors

When you place an order, you are making an offer to purchase the products in your basket.

An automated email confirming that we have received your order is an acknowledgement of receipt and does not, by itself, mean that we have accepted your offer.

Unless we notify you otherwise, the contract between you and Sun and Rocks is formed when we dispatch your order and send you a dispatch confirmation.

If we identify a pricing error before dispatch, we will contact you and explain the correct price. We may offer you the choice of proceeding at the correct price or cancelling the affected order. We will not charge a higher price without your agreement.

If you do not agree to the corrected price, we will cancel the affected order and refund any payment received for it.

If a pricing error is discovered after dispatch, we will contact you and seek to resolve the matter in accordance with applicable law. We will not assume that we can retrospectively increase the agreed price without your agreement.

We may refuse or cancel an order where we have reasonable grounds to suspect fraud, unlawful activity, unauthorised commercial resale or a genuine pricing or stock error. If we cancel an order for which payment has already been taken, we will refund the amount due.

7. Cancelling an order before dispatch

If you wish to cancel your order before it has been dispatched, please contact us as soon as possible at sunandrockswine@gmail.com, quoting your order number.

We will make reasonable efforts to stop the order if it has not yet been dispatched. Once the order has been dispatched, the return and cancellation provisions in Section 9 will apply.

This section does not affect your statutory cancellation rights.

8. Delivery

We currently deliver to addresses within the United Kingdom only. Any delivery restrictions, available delivery options, estimated delivery times and delivery charges will be shown during checkout.

Delivery dates and times are estimates unless we expressly agree otherwise. We will make reasonable efforts to deliver within the stated timeframe and will contact you if we become aware of a significant delay.

Please ensure that your delivery address and contact details are correct and that someone aged 18 or over is available to receive the order and provide identification if requested.

If delivery cannot be completed because the recipient is unavailable, cannot verify their age, or refuses delivery, the courier may return the parcel to us. Please contact us to discuss the available options. Any charges or deductions will be applied only where permitted by applicable law and the information provided to you before purchase.

Risk in the goods passes to you when you or a person you identify to receive them, takes physical possession of the goods, subject to applicable law.

9. Returns, cancellations and refunds

Your statutory right to cancel

If you are a consumer buying online, you generally have the right to cancel your order within 14 days after receiving the goods, without giving a reason.

If your order is delivered in separate shipments, the 14-day period generally begins when you receive the last item. Some legal exceptions may apply in particular circumstances.

To exercise your right to cancel, contact us at sunandrockswine@gmail.com and clearly state that you wish to cancel. Please include your order number and the email address used to place the order.

For change-of-mind returns, please ensure that all bottles are unopened and that labels and bottle coverings remain intact. Any presentation or gift packaging supplied as part of your purchase, such as a wooden wine box, should also be returned in good condition. You don't need to use the original outer shipping packaging, but please pack the wine securely for its return. You must also return them without undue delay and no later than 14 days after telling us that you wish to cancel, unless we agree otherwise.

If the wine or its packaging has been damaged, or its value has been reduced by handling beyond what is reasonably necessary to inspect it, we may make a proportionate deduction from your refund where permitted by law.

Return costs following cancellation

If you exercise your statutory right to cancel, you are responsible for the direct cost of returning the goods to us, including the cost of returning an order that has already been dispatched or delivered, provided we informed you of this responsibility before you placed your order.

You must arrange and pay for the return yourself, unless we agree otherwise. Please contact us at sunandrockswine@gmail.com before arranging the return so that we can provide the appropriate return instructions.

We will not charge you an arbitrary cancellation penalty. Your responsibility under this section is for the direct cost of returning the goods, as permitted by law.

Refunds for cancelled orders

Where you validly cancel under your statutory cancellation rights, we will refund the price of the goods and the cost of standard outbound delivery, in accordance with applicable law. If you chose a more expensive delivery option, we are generally only required to refund the cost of the least expensive standard delivery option we offered.

We will issue the refund within the legally required timeframe. We may withhold the refund until we receive the returned goods where the law permits us to do so.

We may make a deduction where the law permits a deduction for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Faulty, damaged or incorrect goods

If your order arrives damaged, is faulty or does not match what you ordered, please contact us promptly at sunandrockswine@gmail.com. Include your order number and, where possible, photographs of the damage or issue.

We will assess the issue and explain the available remedies. Depending on the circumstances and applicable law, these may include a replacement, repair where appropriate, price reduction or refund.

You will not be responsible for return costs where the goods are faulty, damaged or not as described, to the extent that applicable law requires us to cover those costs.

Your statutory rights under the Consumer Rights Act 2015 and other applicable consumer legislation are not affected by these terms.

Returns information before checkout

We will make our returns and cancellation information available before you place your order. In particular, we will clearly explain that you are responsible for the direct cost of returning goods if you cancel under your statutory cancellation rights.

10. Commercial resale and business purchases

Our products are sold for personal consumption or gifting. Sun and Rocks does not permit customers to purchase wine through our website for commercial resale, distribution or onward supply as part of a business.

We reserve the right to refuse or cancel an order before it is accepted, or to take other lawful action where appropriate, if we reasonably believe that an order is intended for unauthorised commercial resale or another prohibited purpose.

Nothing in this section affects your statutory consumer rights.

11. Promotions and discount codes

Promotional offers and discount codes may be subject to additional conditions, such as expiry dates, minimum order values or restrictions on eligible products.

Unless stated otherwise, promotions cannot be exchanged for cash and may not be combined with other offers.

We will explain any applicable conditions when a promotion is advertised. Nothing in this section allows us to withdraw a promotion contrary to applicable law or a contract already formed.

12. Intellectual property

Unless otherwise stated, the content on our website, including text, photographs, logos, graphics and design elements, is owned by us or used with permission.

You may view and use the website for personal, non-commercial purposes. You must not reproduce, distribute or commercially exploit website content without the relevant permission, except where permitted by law.

13. Third-party services and links

Our website may use third-party services, including payment providers, delivery companies, age-verification tools and external websites.

Those services may be subject to their own terms and privacy policies. We are not responsible for third-party websites or services to the extent that the law permits, but this does not affect any rights you may have against us under your contract or applicable law.

14. Privacy and personal information

We process personal information in accordance with our Privacy Policy, which is available on our website.

We use relevant information to process and deliver orders, take payment, communicate with customers, carry out age verification, prevent fraud and meet our legal obligations.

Please refer to our Privacy Policy for further information about how we use and protect your personal information.

15. Liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these terms limits your statutory rights as a consumer, including your rights in relation to goods that are faulty, not as described or not fit for purpose.

Subject to the above, we are not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control, to the extent permitted by law.

If an event outside our reasonable control affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate. This does not remove any cancellation, refund or other rights you have under applicable law.

16. Changes to these terms

We may update these Terms of Service from time to time, for example to reflect changes to our business, website or legal obligations.

The version in force when you place your order will generally apply to that order, unless a change is required by law or we otherwise agree with you.

The latest version will be published on our website with its update date.

17. Complaints and contact

If you have a complaint or question about an order, please contact us first so that we have an opportunity to help.

Please include your order number where applicable. We will make reasonable efforts to respond and resolve complaints promptly.

18. Governing law

These terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in the part of the United Kingdom where you live provide otherwise.

If you are a consumer, you may be entitled to bring legal proceedings in the courts available to you under applicable law. Nothing in these terms removes those rights.

19. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. Any unlawful or unenforceable provision will be interpreted or limited only as far as necessary to make it lawful and enforceable, where possible.
